I agree with the federal judge's ruling, but unfortunately, I don't think that this is necessarily an indication that the people of the US are taking their country back from the neocons. For one thing, one judge's opinion doesn't necessarily reflect popular opinion. Also, you can be sure that Bush & Co. will fight this thing tooth and nail. Alberto Gonzales has said so.
Ricky T: Who's a fan of judicial activism? It's funny how the conservatives constantly complain about the "judicial activism" of liberal judges, but overlook the obvious cases of judicial activism of conservative judges, such as was the case in 2000 when the Supreme Court handed Bush the presidency on a silver platter.

It was the only decision according to article IV of our Constitution...All that had to be done was run it through court and the Constitution takes care of the rest. These morons here don't have a clue that with out freedom our Nation weakens.

Ah, I see we have a fan of judicial activism here.
For the record, there's nothing even slightly unconstitutional about the NSA's wiretapping.
Read the constitution and you'll find nothing in there that even slightly prohibits it.
Not to mention the Privacy Act specifically ALLOWS it.
What we had in this ruling is the Judicial Branch of the government attempting to grab more power than they have.
They ruled that something was unconstitutional, not based on the constitution or law, but based merely on the fact that they considered it wrong.
The judicial branch needs policing, they are trying to upset the checks and balances inherent in our government by making themselves the most powerful branch.
