There is no difference. I totally agree. I guess a prostitute should carry a video camera with her and in case she gets caught, she can tell the cops she's making a movie.

If you have ever been to Europe where prostitution is legal and state regulated, where the ladies have to get monthly doctors clean bill of health cards, and a portion of the earnings go back into the state healthcare system. It is a good idea for an earnings potential and can offset budget issues, but the big difference from there to here is most persons in the U.S. are not open-minded and do not like being told how to run their lives.I visited Germany in 2002 and was impressed at how their government ran things like the prostitution rings, the enviromental laws, the vehicles on the roads were not all run down, and local governments kept their towns safe and cleaned up.Unlike here where everything is all about the mighty dollar and who can make more of it, and to hell with the little guy trying to survive, we only get educated on how illegal everything is in schools, so we grow up not understanding the way things could be. So a porn star is in the entertainment industry and they have a lot of influence in what the governing laws should be, they must have the idea if you have porn on movies you are making them money, if you get prostitutes to do the same things they don't get the money for your entertainment.

Trust Society to cramp down on porn stars - - - they are often the target of arrests and blackmail. All laws against 'prostitution' are insane & immoral. Prostitution is a 'local ordinance' issue; the communitty levies criminal charges against those that violate the idea that people should hae some say over what they do with their own body or the bodies of willing others. Since there is, thus far, no state or federal statue against prostitusion they have to go after porn stars in other ways. Usually the Evangelical Christian attack Dogs use the IRS to take down Porn Stars. Audits and other forms of harrasment. SO if your concern is that one form of prostitution is punnished while the other is not - - - think again. Christian Zealots will most likely stomp out sex within our lifetime. Four more years of Bush and there will be no playing in the Bush. Peace.

You have a good point there but I think prostitutes are thrown to jail because they have a higher risk of giving a decease to a person & porn stars have a phisical check up before they perform any sexual activity. Also,it is legal if you are video taping sex because you are signing a contract to make a movie.

First, I am not an expert of law, entertainment, or business.
I think the difference... why one is legal, and why another is not... comes down to what the actual job is.
A prostitute's job is to have sex for money. Having sex is not a legal job... except in Nevada.
A stripper's job is to dance for money, and to remove as much clothing as the law allows. Dancing is a legal profession.
A porn star's job is to act in a movie for money. It happens that as part of the "role" they need to have sex in the movie. Acting is not illegal, even though I wish it was for some ;-)
I guess dancing and acting are a form of artistic expression which is protected under freedom of speech laws. Prostitution is not a form of artistic expression, and therefore does not receive the same protections under the law.

Technically the porn star is being paid for the movie she is making.
The Prostitute is only getting paid for sex.
It is stupid difference and really hookers should be legal since, as George Carlin said, if it is legal to sell and legal to have sex should be legal to sell sex....plus then we can regulate and tax it

One signed a contract, and had to ( for the most part) audition for the job
EDIT: Also, these days, a porn star has to prove that s/he is std free.
