I really need some immigration help here.Please!I came here on a fiancee visa to marry my husband-now,have a family and start from there. But things started to get so dirty between us when i got pregnant. He demanded i'll get abortion but i chose to keep it. He threatened to have me deported, all kinds of stuff to hurt me if i wont but it still didnt change my mind. Anyway, now i gave birth to a healthy baby boy, but it didnt make things better. We still get into arguments/fights a lot of times over the abortion issue and it just hurts me so much of how blind i was to believe that he is someone i could spend the rest of my life with. Most of the time that we argue he would say things like he'll leave me all alone to raise my son and all kinds of hurtful things he could come up with. How can i stay here legally if i divorce him? i havent have my adjustment of status interview yet. oh he has a domestice violence record when he got physical with me bec. of the abortion issue.

The firm I work in has dealt with something very similar. Consult a good immigration attorney. You can go for the adjustment of status interview without your husband as long as you bring proof of the abuse (i.e. police reports, letters from friends, counseling/therapy information). You WILL need representation from an immigration attorney. If the officer believes your allegations, he/she can grant your conditional permanent residency in the US even if your husband didn't attend the interview.

You should be deported for stupidity because you are asking these questions to a group of morons on Yahoo!!! Have you thought of going to immigration? Don't be hiding in the cracks about this. Get some advise from people who are able to help. If it means that you are not legal to stay then pack up your stuff and go where you are supposed to be. We don't need any more illegals in the USA!!!

wow.well sweetie first of all you need to report all of the abuse to the police immediately. Whether or not you divorce him that needs to stop. Second you need to contact an immigration lawyer for your exact steps and procedures, but the abuse and threats are enough to prove fraud on his part so if he tries to have you deported you can have a legit claim to stay. I am not sure of your living status, but depending on the outcome you should even be able to get palimony if you have been together long enough. Email or call an attorney and don't be afraid of deportation. You will have to provide sources of how you will be able to take care of yourself, but he sounds like you need to get away from that environment. Good luck

i think you would be able to stay here because you had your son here and obviously your husband doesnt want him. go to a lawyer and talk to him. try to get things going on becoming a legal resident and let the lawyer know you are trying. good luck with that.

first of all, go to the local citizens advice bureau and ask them. it doesn't mean you'll get deported if he divorces you. if he's violent, go to the police .good luck.

all you have to do is get a form and get copys of the violence and you can apply to still get your adjustment...
