I'm really in the mood to sue someone tonight. Have you heard of anyone suing for this reason??

LOL. ok. let me stop laughing and answer this thing for you. (and i was taking you seriously until that last line! geez) why would you want to refund money that went to the welfare of a harmless, innocent child? and to be asking "b/c you never know??" but to answer your question, it's highly unlikely. the money wasn't for the lieing azz woman you deceived you, it was for the child. and if you did not spend the bucks to establish paternity, then your payments will be construed as "voluntary" IF you are one day determined not to be the father.

the only circumstance that i can think of where u MAY be able to sue, will be if the mother somehow committed fraud to make you believe you were the father. but again, this is virtually impossible short of her forging, or bribing someone to give you a fake paternity test. if you didn't test, that's your fault. so go give that kid a BIIIIIIIG BEAR HUG...daddy.

That is a really good question, I think its different with every case.
Were you at all involved with the child, (while the mother is pregnant apparently counts nowadays.) If so, you may still have to pay child support. But if the child really is not yours, then the mother should have the decency to not make you pay, and give you back what she can afford, without comprimising the childs welfare. My brother went through this same thing, she said it was his, but only after his murder was it proven the boy wasnt his.
Keep in mind, if you pay childsupport, it gives you leverage in a trial, even if you have never seen the child. If she is an incompitant mother, you can file for rights.

Assuming you have positively tested to make certain, and are not just reacting to someone's story:

So for years you paid to support a child (presumably with a name) who thought your were his/her father and you thought was yours.

Do you have no feelings for this child? They are an innocent victim in this. Try not to take out your rage for his/her mother on the kid.
Try to remember the time you spent with him/her.

If all you have been doing for years was paying money with no visitation, then you have only yourself to blame for not having a paternity test done before.

Sueing won't help the kid. Why should he pay because you could not figure out you were sleeping with the wrong broad?

Just get yourself fixed and save us all having to raise one of your welfare babies.

I have no idea, I would imagine you could sue anyone for any reason. You should have a paternity test which proves the child is not yours (If there was ever any doubt, you should have had it done long ago)....But if you have concrete evidence then I would assume you have a fairly decent case.

I believe that you can sue her if you can prove that she intentionally mislead you, or if she has 2 fathers paying for the same child. However you must be able to prove it with more than hearsay, you will need some sort of physical evidence.

No you cannot. They will tell you that if you had any suspicion when you were served papers for child support on the child then it was your responsibility to get a DNA test done.

No. How about you sue my ex for the CS he won't pay for the kid he knows is his cuz he signed the adoption papers same day I did?

odd ususally they'll order a paternity test before u start paying...unless u were married then its by request. is ur name on the birth certificate...if so i doubt u can but maybe
