The number 3 is not retired. The team owner, in this case Richard Childress, is the person who "owns" the number - or to whom the number is assigned by NASCAR. (Along with the 07, 29 and 31) Just as Rick Hendrick "owns" the numbers 5, 24, 25 and 48. The number could be used again if he so chooses.
Since Dale Jr. drives for DEI, not RCR, he cannot use the number unless it is approved by Richard Childress and NASCAR (very unlikely) - or he were to leave DEI and drive for RCR. He was offered the number a few years ago, but declined.

It's not retired yet. Richard Childress still owns it. Teresa Earnhardt doesn't want it to be used in honor of Dale Sr. Dale Jr. wishes to drive the #3 car some day but not anytime soon.

NASCAR has not retired the number per say.The number is "leased" to RCR team.Out of respect for Earnhardt.As a tribute to Earnhardt it was offered to Jr but declined.
Yes it can be used again but not in the near future.

Out of respect, the number will not be used in the Nextel cup series for quite some time. It will be used again, there are only so many numbers...
