When I got pregnant 8 years ago, my boyfriend offered to give me an abortion w/a coathanger. Now our son is 7 & he's never met his father. His father owes almost $36,000 in back child support & refuses to keep a job. His parents are very wealthy. When they pass on, he will inherit their money(much more than he owes). Can his back child support be taken out of his inheritance? I moved last year, so the order is transferring to Florida. Also, I married 3 yrs ago-my husband is the only father my son has ever known(since age 1 1/2). My husband wants to adopt my son. Will my son's father still owe the back child support if my husband adopts my son? We know if adopted, no more child support would be added to the arrears owed my son.

Inheritance can be taken for back child support. I don't think the debt goes away if he adopts but I really don't know. Hey join the club on incredibly large sums of child support owed to you. Unfortunately it happens way to often, good luck!

You are lucky that your son has not had the misfortune to have that degenerate in his life so far, But don't forget that someday he will want and need to know his biological father. Check with a lawyer but I do believe that you can put a claim on his inheritance when he does receive it. I do know that to have your husband adopt your son, you will first need to terminate your boyfriends parental rights which in turn I believe would terminate what he owes in child support, at least for the future. Again check with at lawyer on that!

Well, my husband's daughter was adopted, but he still had to pay the back child support up until the day she was adopted, but none after. So, yeah he'll still have to pay the child support he owed before the child is adopted.

All tax returns and all inheritance, and any other form of money that he comes into can be taken for child -support.

If you keep on your case worker to get the money, they will make sure if he has any bank accounts or anything like that - that you get the money from it.

Just remember though if he is current on child support, that gives him rights to see your child. If you refuse to let him see the child, then you can go to jail.

I would walk away from the money, just to keep my kid away from the looser.

He is obviously not someone you want your kids around.

Good luck./

Yes it can be taken out of his inheritence. I had the same problem with my own father, and after he passed away i got the money back the he had owed me.

Well its a little late to bring all this up now. You should of struck while the branding iron was hot. Inheritence or not, you are going to have to take legal manuvers to get him now. Did he sign the birth certificate? probably not. What do you want anyway, happiness, repayment, a solid relationship for the son?
