Your question needs more detail. If the accident involves something that should have been locked-out, there is employer liability.

Being an Electrical Engineer in an automotive plant, All employers (unless they are stupid) have their Lock Out tag out system in place. I do think the new OSHA ARC flash requirements are a bit paranoid. Anytime I get into a panel I ask myself, Where is the live stuff and how do I stay far far away from it.
When Accidents do happen it is usually the technician who is inexperienced or just sloppy. Any employer that tells an employee that they will not provide them with safety equipment when asked by the employee has just set them self up for disaster on the employee's part as well as the Business.
There is no such thing as Employer Liability in this unless like I said the Employer refuses to supply the proper PPE for the job.
