It's a grand theft, rather than embezzlement. The two are similar though. There is a statutory upper and lower limit for sentencing but from a practical standpoint, you can't go by that. The responsible person probably won't get the maximum. There are variables. Some of which are whether they have much of a criminal history, and if so, is any of it theft related. And whether they make restitution, or become defiant over the whole matter, and there's alot of influence from the probation report that's done on felonies. They could conceivably walk away with probation as a low end punishment. All of this of course depends on whether the case ends in a conviction. I don't know how hard or easy it is to make a positive ID on a tire. You probably know. I don't.

This is a matter of state law. With 50 different states, there may be 50 different correct answers and you failed to state where the alleged crime occurred.

well it depends on what state it was in, some states the punishment can be more severe I know that in my state the max is 364 days in jail and up to $5,000.00 fine
