Legally on a background check they can ask about any aspect of your former employers, and if you sign the release form they you are releasing them from liability as long as they give truthful, factual answers. Many people are under the impression that an employer can not give out information about you other than name, title, employment dates. That is not true. The problem is when a former employer gives out untruthful information with the intent of harming you or causing you to not be able to get employment. If you are concerned about what they may say about you then have a friend call them and ask for a reference check on you.

By Law, all they can ask is about attendance and attitude, how well you worked with other people...No money can be discussed from a past employer

were you ever late
any compatibilty issues with other co-workers
any breach of rules or regulations
would you hire her again (is the big one)

they will find out your salary eventually.
