A judge ruled today that the warrantless wiretapping by the government was unconstitutional and ordered them to stop. So my question is this: Why can't the White House just go to the FISA court and get a court order retroactivelly? If they did, they wouldn't have any problems with it being unconstitutional because the courts would have given them permission. If they would have done this in the first place, they wouldn't have had a problem. Are they just too proud to admit that they went about it the wrong way, or is there something going on that they don't want us to know about?

You got it.

Just about everything the administration and the NSA have done, could have been done within the laws. Or they could have tried to get the laws changed to allow them to do what they want. With the same party in control of Congress, it shouldn't have been that difficult.

Bush just doesn't want to acknowledge that he must follow the laws. He believes that the Executive branch should be pre-eminent and outside the scope of either Congressional or judicial review. He's said so, and so has his Attorney General.

Bush just doesn't respect the law enough to follow it. And once again, he got caught breaking it. After the number of times the Supreme Court has had to slap him down for exceeding his constitutional authority, I doubt they'll be very forgiving this time.

The 'issue' is that the lists of numbers called, outside the United States,, that were never protected by our Constitution, are suddenly protected because a Carter appointed Judge has decided it should be.

Lists of phone numbers are not even protected in our 4th amendment, as 'personal papers' privey to the law, no matter if they were of Americans.

It will be overturned at Appeals Court, which is a stain upon this jurist's record. There are few hills upon which one can 'die' before one is removed from the office.

they shouldn't be allowed to retroactively do anything! They broke constitutional law, and they should be INVESTIGATED for compromising the liberties of American citizens! They had their chance to do it the correct way, and they chose instead to buck the system, and that 'goddamn piece of paper' we call the constitution!
