It depends on your situation and what the court order is. If he's ordered to provide insurance, then he's making the monthly premium payments and whatever it doesn't cover is your responsibility. If, however, it's not worded like that (although most of them are), then it comes down to a responsibility issue meaning that both parents are financially responsible for any expenses incurred by the child. Which means anything not covered, is split 50/50. Check your paperwork first before you start asking him to pay half. It's very rare that the amount uncovered by insurance would be solely his responsibility and if it's not written that way specifically, he will argue it and not be held responsible for anything because of the amount he pays in premiums. I hate to say it, but I see it all the time. The judge looks at those monthly premiums and consider them to be his contribution towards medical bills. Which leaves you to pay the rest. Like I said, look over your order first and if it says nothing, ask for half, more than likely he'll agree. It's a reasonable request and it is his child. If you go for it all, he may start asking questions and you'll be left holding the bag.

Don't know about the state you live in but.. years ago men had to pay the full amount that insurences didn't cover and if he didn't pay it .. then the mother had to and then take him back to court to recover the expenses if she could afford to do that...
Now in WI it is 50 50 split on all bills the insurence does not cover.. but.. still if the man does not cover his share it is up to the women to take him to court to recover the expense.. doctors, dentists, hospitals do not care who pays.. they make the person that took the child to the hospital or doctor sign a paper to say they will be responsible for expenses the insurence does not cover.

So the father has to pay to maintain medical insurance for the children and any other medical treatment bills that the copay doesnt cover.

if you are responsible for the minors health care, then you pay the rest of whatever the insurance company didn't pay.

on every child support worksheet, there is a line about uninsured medical expenses. If you receive child support, you are responsible for (usually) the first 6% of the child support obligation paid yearly. It should be spelled out in your divorce decree and or on the child support worksheet.

i take it that you and the father arent together anymore...usually as far as the court is concerned any amount not covered by the ins co. is split in half by the two parents

You should split the cost with the ex. After all it two to make them it should take two to raise them even if you are no longer in the house.

My divorce papers specified, but my ex never paid a dime. If your documents specify, but he's not taking care of it, take him back to court. If they don't specify, you may still have to go back to court for clarification or to add it.
