A restraining order was served on another tenant in an attempt to have this tenant removed from the apartment because she refused to leave (her name is on the lease as well as the other person) after an argument. Is this legal?

There are a couple of conflicting issues here. First, your roommate's name is on the lease so you can't have the tenant removed from the apartment. She has the right to use and possess the apartment (that is her contractual and legal right). However, an order of protection or restraining order can be served on another tenant but not in order to remove her from the apartment. Apparently you can still live in the same living space and have an order of protection against one roommate (I was told this by a policeman).
