I had a car wreck about 10 months ago that wasnt my fault. I wasnt hurt but my car was totaled. It was a 1995 but in really good shape. I think I would have to go to small claims court. I live in MS and the maximum is 2500.00. My question is, Is it too much of a hassle to go to court over this and how long should I expect to wait before I would get a court date? Also, what if the other person doesnt have the money to pay me? I think its totally unfair that this person hit me and has got away with it.

I had no insurance at the time. Neither did the other party. She also was arrested for driving without a license.

I got a ticket for not having insurance and paid it. Just because neither of us had insurance, she gets off the hook?

you have to decide...either way it's gonna cost you...either with the cost of court or when your insurance goes up b/c the idiot that hit you doesn't have any...and the court could rule in your favor but if the guy doesn't have the money to pay-what can you do? i'm not sure what they do when people can't pay. i really hate that you're having to go through this. maybe you could get some financial assistance from the county or from a government service where you live. it doesn't matter if you were hurt or not. this person should replace your car or pay you to get another one. good luck.

No, dont pursue a lawsuit. You werent hurt, right. Be greatful for that. This is the problem with todays society. Everyone wants to sue everybody. Get money the easy way. And people wonder why our insurance premiums are so high. Besides you say the max is 2500. By the time your lawyer gets his cut, usually 33.3% the remaining balance is pennies. Leave it be.

Didn't you call your insurance company? If they totalled your car, their insurance company should have paid for it. If you do take them to court, you have to make sure you have documentation of the accident, the police report, the repair costs and/or estimates, the comparison cost for a new vehicle and whatever else you can think of.

If you were driving without insurance, they have the same claim against you...just get insurance, and forget about it.

Didn't they have insurance??? You sue the insurance company. Did you have insurance?? You sue your own insurance company if you have uninsured motorist coverage. If no one had insurance, then you are all just plain dumb, as you will end up in jail.
