The doctor that delivered my son through a C-Section birth broke his leg (femur) during delivery. There were no complications other that my son being breech. These deliveries are successfull everyday. I want compensation for his quite extensive medical bills resulting from the broken leg. I can't get a lawyer to touch it. Why?

You may sue anyone for anything. The question is whether you can prevail in the lawsuit. In your case, you must establish that the doctor failed to provide the proper standard of care for you and your son. If the doctor was truly negligent, then you are likely to prevail. If the doctor exercised proper caution and performed within the accepted standards of care, you will not prevail. As for finding an attorney, do not spend your first few months worrying about that: spend the time bonding with your baby. Put some feelers out to different attorneys and see what happens. If the attorneys specializing in malpractice and personal injury shy away from the case, then you have a good indicator that the case will get nowhere.

I think people that are willing to sue doctors at every chance they can are terrible people. Im not a doctor and I don't even know doctors personally. Think in the future if this trend continues. Do you get sued if you make a mistake at your work? In the future nobody will want to be doctors because they are afraid that they will be sued. Now don't get me wrong I am very sorry that your baby broke its leg and I don't have all of the details on the delivery but I would see if there are other means of maybe receiving the money for these bills instead of suing the doctor.

I would have to say yes that was from negelect of a doctor that delivers babies everyday and should have known that something wasn't right...I definately would call my lawyer even if it's just to get the medical bills paid that doctor should be responcible for paying..

Keep looking for a lawyer but if the doctor could not avoid breaking the leg or even tried to prevent it as well as he could you might not have a case there.

It depends on the documents you signed b/f giving birth. If you carefully read everything and it didn't mention anything about complications held responsible by teh doctor or something to that then yeah you can sue.

Yes you can. You need to hire someone that does malpractise lawsuits. Call a lawyers office and when they say they can't help you then ask them if they could give you the name or firm name of someone who can. good luck and bless you and your son

i guess your in the usa ,,i would say that you may be best to research this on hte net,, and see what you can find,,yes if it was me i wouldn`t just want to leave it personally..poor little man,,type it into google and see what you get, maybe the law and child birth or breech birth complications,,hope this helps..good luck!!!

I'm so sorry for your grife in the breakage of your new born son's leg. As a parent of a son myself, I am only interested in my sons wellbeing and safety. I don't know all the details in your case and I don't want to sound harsh here so I'll say this much. Thank God you and your baby are alive and here to bond with eachother. Sometimes in order to save or help others things must take place in order to help. You mentioned your son was a breech baby, and yes, these cases are common but very tricky. I've heard of babies dislocating shoulders, popping little bones in delievery. This is a HUGE stress on our little babies. To save someone sometimes calls for some injury before they can get through. Maybe you and your son where in a moment of distress and the doctor needed to be able to react to save him AND you.
I would be grateful the doctor was there to protect you, but remember they are not perfect. It's so tricky...a doctors intentions and education teach them to save, help, protect and heal their patients...but they run the risk of being sued for anything. I personally think we expect too much from them. They are humans too. Capable of compassion but also imperfect.
If my son was in distress and needed help, I would be so grateful my son is alive and safe in my arms after being saved.
Since you are trying to sue to have money to cover your son's medical bills, maybe you need to approch the money differently. Contact your church and ask for help. Save for it, work out a payback plan with the hospital or doctor. Bottom line is being grateful for you baby and the teams of people who took care of you and him. Unfortunatly money is needed to get things done, but in my opinion, I would sell my house, sell my wedding ring, sell the clothes off my back to save my son and pay for ANYTHING my son needed instead of trying to get the money out of sueing the one person who saved him.
