My job is down sizing and some people have quit. I feel they may ask me to fill in those positions where they are short but it is not something I'm interested in doing. I don't want to work in a different department. I would like to know if I don't except this new position will I be able to file unemployment because I'm sure they will offer it to me and then tell me if I don't take it my services are no longer needed at the job.

No. As long as it is the same pay rate and you lose no benefits it is at the discretion of the employer to schedule your hours. You can not quit and collect unemployment.

It kind of depends on which state you live in, but generally, if your employer offers you a different position, it's your choice to turn it down or accept. Unemployment is for people who can't find a job. In this case, your current employer is offering you a position. If the shift is something that would interfere with a child care situation, then you may have a valid case with your unemployment office.

According to most state unemployment regulations any position turned down for employment of any gainful position is cause for termination or denial of unemployment bebefits. No way around that one a job is employment no matter what the position so, unless you are physically unable to do one of those other positions, you have no choice bu to accept or find emp[loyment elsewhere doing what you do currently.

if they fire you for that, you can definitely collect unemployment, however, if you quit, you cannot collect..
