In most states, there is very little difference legally between a formal Legal Separation and a Divorce (or Dissolution of Marriage.) The only difference is that a Legal Separation does not allow you to re-marry. If you go through the Court for a Legal Separation, the Court will enter division of property, parental privileges, alimony, etc. In most states, you can convert a Legal Separation to a Divorce at any time. If you just live apart, as suggested by some other answers, without legal protection either of you can borrow money, get credit, or go into bankruptcy and the "spouse" could be responsible even if you did not know about it. You don't need a lawyer, but you do need a legal paper to protect yourself. You can set it aside later by simply dismissing the action in the Court.

A legal separation means you have filed with the court and are legally separated. You are no longer responsible for the other person's debts or business transactions. Call the courthouse in your county to find out if legal separation is an option for you.

If you just separate and do not file it doesn't mean much. You both are still responsible for any debts you each incur while separated.

A divorce means you have gone to court and have been legally granted a divorce by law.

It differs from state to state of course but, being legally separated means just that - you are still married with rights to all shared property. HOWEVER - in order to actually get divorced, or say if you had a change of heart, and you wanted to be married to the same person again, you would still have to go through a legal divorce to move forward in anyway.

A divorce means you split all shared property and you are not married anymore.

Divorced eliminates the legal aspects of being with another person such as debt. When you are legally divorced you become a single person and there is no other person involved in what you do. When you're separated, you are still legally married, just apart. Therefore, if you buy that car you just couldn't live without, you also include your spouse who could just drive that car out from under your butt!

Separation is temporary disunion between two married people in order to give each other time to think over a contentious issue in marriage while divorce is a legally instituted separation of a married couple. In divorce, the couple cease to bear any identity to each other as either formal wife or husband.

Divorced is the resolution of a marriage with division of assets and and court mandated support payments.

Seperated is still in the union of marraige but the couple are not co-habitating or in most cases sharing finances. It's something that is officially noted in some divorce cases. Infidelity during seperation isn't as much of a serious issue, it can also be used to agrue for greater or less support based on how well the spouses are opperating without shared finances.
