If you get a good enough attorney, you can file on grounds of adultery and not only kick her out of the house, but keep custody of the kids and not pay any alimony.
Make sure you have strong proof of the adultery - phone records, bills, etc. (of course, confessions are better).

If she is being completely unfaithful to you then you should just tell her that it is best for her to leave. Let her know that the tension between the two of you has gotten worse, and that you don't want your children to have to be exposed to it! You should go and file for your divorce, and custody of the children. And if she gives you any bull about it, you should go and see a lawyer and see if you can get a restraining order put on her!

Take a chance in court and find out. If you can prove your wife is a adulterer then the court might view you favorable because she's the one who violated the marriage vows and created the disharmony in the marriage.
If the court feels she didn't act in ways that was in the best interest of the kids, then the court might view you favorably so I suggest you take a chance if your not happy with your marriage and see what happens instead of guessing because when you continue to guess at something, you might never know the outcome.

You should get a lawyer and file for divorce. Under the circumstances there is a good chance the judge will at least give you joint custody and will probably allow you to keep the house. If she files first - it gives her an edge in court.

There is a lot of thing you can do. First and foremost though is to report to the police and have her caught in the act while having sex with anyone of her boy friend. Then you can easily file your divorce and stay where you are. She cannot claim anything from you once proven that she is cheating on you.

Im sorry that you have to go through that.I would suggest that you talk to a lawyer and get your ducks in a row before the divorce hearing.I would fight for that house.If you are wanting custody of your kids she will fight you on that im sure.The only sure way to get what you want is to get yourself a very good lawyer.As for her cheating adultery is grounds for divorce try getting eveidince to take in court with you.Good luck

adultery, adultery. Which is your state of residence. Each state has specific issues on adultery. If you now about it and have allowed it to happen again - some judges will say you never learned from the first time. BUT you definitely have to file first. Get an order to have her out of the house. Cruelty, humiliation, pain suffering, and adultery. In some states the intent is good enough.

Yes its possible but...... First you need a lot of proof. I don't know exactly how you can get that other than spying on her or something to that affect. Second you will have to spend a good bit of money on a really aggressive snake in the grass lawyer. If you have the proof then you shouldn't have a problem as long as you have a really good attorney. There is no law that says the man has to leave the house and children. You have every right to stay in your home and have her leave.
I'm really sorry about what she has done to you and your family. Cheating is a very selfish move.

Under the circumstances, I'd file for divorce, and ask for a hearing in order to determine custody....and to help you in your favor, document as much of her lifestyle as possible....if you've got proof she's doing all of this, the judge will take that into consideration....
