I'm assuming you mean using it in connection with real estate services. The term REALTOR is owned by the National Association of Realtors. The trademark record can be viewed by going to http://tarr.uspto.gov and entering the serial number 71540013.

Here's what their web site states:

"REALTOR® -- A Registered collective membership mark that identifies a real estate professional who is a member of the National Association of REALTORS® and subscribes to its strict Code of Ethics."

Yes ! They can fine you if you are caught, that is unless you are a member of The Realtor association . I am A Real Estate agent bu not a Realtor . I was for 12 yrs. though
