I was driving through the mountains and hit a deer with my 86 gremlin so shouldn't they be responsible?

Oh deer me. It sounds like you are on the horns of a dilemma. Was the deer jerky when it was hit? Well it can cost a lot of doe, but I would not try to save a buck or two. Get a lawyer that specializes in uninsured wildlife. Be tough. Don't fawn all over him, or you will pay dearly.

Yes and good luck. If you can prove the deer acted on their instruction or lack of education to prevent such accidents. Was the deer standing still? Then you could be charged with vehicular assault. Sued for the deer's damages/ treatment and recovery, did you leave the scene or make a police report. Most important are you ready to go on record for saying that the deer exercised poor judgment when you ran the dumb animal over with your car? Why doesn't your car insurance cover it? Sounds like it was an accident or maybe you intentionally did it for the money to get a better car.

Most insurance buyers probably do not know that damage caused by "collision" with a deer or other animal is within the scope of their personal auto comprehensive, or "other than collision" coverage. They probably assume, quite reasonably, that their collision coverage, normally subject to a higher deductible, applies.

If you hit an animal
If you cannot stop in time, unfortunate as it may be, it is usually safer to hit the animal than to swerve. Swerving may land you in the path of another car or off the road in a ditch.

Pull over and call the State Patrol (dial *CSP from your cell phone in Colorado) or local law enforcement to report the accident. If the animal is still on the roadway, they can safely remove it.

If the animal is still alive, it may be dangerous for you to leave your vehicle.

If you vehicle is unsafe to operate or you are injured, stay in your car and wait for help.

Call your insurance agent at your earliest opportunity. If you carry optional comprehensive coverage it will cover damage caused by a collision with an animal.

Everybody knows gremlin's love deer! I'm surprised you didn't get a bill from the Wild Life people because your gremlin sniffed out that deer and gobbled him up!!!

Unfortunately, a deer, moose, elk, or any animal on the road is not the responsibility of Fish & Wildlife, it's called Nature :)

Tell the deer that one....No the Fish and wildlife gaming commission would just get a big laugh from it..... that is an act of nature....Don't sweat the small stuff.....
