my boyfriend that i live with is going through divorce , both of us are,, his soon to be ex is trying to take out a restraining order on him to try and get him moved out of my house until the divorce is final.. can she do this ? she has done nothing but harass us . we just want to be left alone, we are both happy , and both left terrible marriages. I've never heard of this happening, and i'm just curious if i have anything to worry about...
please help.....

She can not do this, the judge would laugh her out of court...You two need to keep a record of everything she has done this includes time and date of the incidents. You also need to get a restraining order put on her for both of you...

No, she can not put a restraining order on him to keep him out of your house. Sounds like you need to the restraining order against her for you two though. I would have him tell her that if she needs to contact him she should do it through their attorney. Have him say this in front of the attorney, so he has a document of it. Then if she harasses you two further, document everything. This also goes two ways, he can't be calling and harassing her either. Does he have kids with her? If so, he would have to go about things a little differently. He won't be able to have the kids for overnighters at your house until, they are divorced and you two are married. Of course only talking through the attorney, isn't really possible with kids in the picture. In that case, I would tell her the times she can call and discuss the kids in front of the attorney. That way she isn't calling all the time and at all hours of the night.

Sounds like to me she doesn't want to see him happy, ignore her. She can not get a restraining order and make him move out of ur house, however if he is harrassing her then she can get a restraining order against him but in that case he can still live with u. Wish her well, and try to ignore her the best u can. People thrive on the misery they create for others and she is just hopeing this will put a strain on u and him. DON'T LET IT IF U ARE TRULY HAPPY!

If he has children, she can require that they not be allowed to have overnight visits while you are co-habitating. She can't force him to leave you. BTW, what is the compelling reason that you two have to shack up while you're still legally married - do you think it's not adultery because the divorce is in process, or are so hot for sex - my guess is that you two were cheating on your spouses so that you'd have "someplace" to land - I know, that's what my ex did. Oh, and if you put his name on your house before the divorce is final, his soon to be ex can get a piece of that, so you might want to be careful. I'm not saying she's right at all (she's not), but you're not behaving in a very mature or adult fashion yourself.

You gat a restraining order to keep someone away from you. She can't put a restraining order against him so that he stays away from you. Don't worry about it. Tell her good luck with the restraining order.
