I have a friend who's wife is an illigal immigrent. they got married just to keep her in the states and now she will not give him a divorce its been much longer then the min time to get your US citizenship and hes given her everything she asked for in the divorce. is there a way to make her sign the papers? can he have her deported and then file some sort of motion? how do you deport someone? any real ideas would be great i am really worried about my friend she is a horrible wicked person.

She is not a citizen but she could if she filed the papers... but she never has her visa expired years ago and they have been legally seperated for like almost two years. she is from south africa or something. My hubby and i have been trying to help him thru this (we all went to HS together) and we just dont know what to do. his attorney is worthless and this is the third one we have went to.

but getting her deported would be a fantastic bonus for all the trouble she has caused.

I really don't understand what the problem is, if he filed for divorce it will go before the court and be granted eventually, especially if they have been separated that long. You don't even have to notifiy the other person, I mean yes they attempt to, but even if they don't know where the other is, they never sign papers or come to court the divorce is still granted. Its not something both parties have to agree to, if it was very few of them would ever be finalized. After a certain period of time passes it is granted regardless, that varies depending on what state you are in but still. I wouldn't even worry about all that deportation stuff. Thats all her problem.

Not being a lawyer- but she will still be a US citizen and she doesnot have to sign the papers but you can still get the divorcebut it will go to court-- the courts will force her to be there because it is a contested divorce- if she fails to appear she could go to jail and his divorce will be granted with or without the wicked woman blessing

what nationality is she? can't he moved out somewhere or to nowhere she can find him then he can file for a divorce after so many years separation? shouldn't get into those sticky situation in the first place. i feel sorry for your friend.

Have your friend call immigration and ask them for some advice.
