As to the question...It depends. If you're bartering for say, mowing her lawn, you must pay the applicable tax on the gowing rate of such a service. The government looks down on people avoiding paying tax. For example, if you go to a mechanic and agree that he'll overhaul your engine in exchange for you to drywall his basement, thinking that because no money is exchanged, no tax must be paid, youre wrong. Otherwise, the government would lose an awful lot of tax revenue.

I don't know about Ca.'s laws, but in most states, as long as it is done in the privatcy of one of the consenting adults' homes and the door shut and windows close (no advertising), it should be legal
