It all depends on who has how much custody. My ex & I share 50/50 and neither one of us can relocate with the child.

It depends on a few things. One being how well you and your soon to be ex get along. Then the courts take into consideration the age of the child and the relationship that child has with each parent. So let's say you have a good relationship and the child is young...the courts would typically order that neither one of you could move more than 300 miles (driving distance) away from each other. If they are a little older, then you could move and arrange summer/school break vacations with each party bearing half of the costs.

It's rather complicated, and it depends greatly on your situation. Each case is different. I will tell you though, that if you and your soon to be ex reach an unconventional arrangement that works for all parties involved, the courts would most likely approve it.

Whatever you decide...please keep in mind the needs of the children. They should be your first priority in situations like this. All too often their desires get swept under the rug and the parents do what is best for the parents and expect the kids to adapt.

Check your divorce decree. Mine stated that either of us could move as long as we gave the other a 30 day notice. Of course if your moving to a better environment for the child and can prove it a judge probably wouldn't tell you no.

My ex and I have 50/50 and because I left the area, I am responsible for p/u and drop off of my kid from the town I left them (where they still live now) but had it documented that if they ever chose to move out of the area, my ex is responsible for the transportation of our kid to the original point of where I pick him up normally. Have it done legally (ex is a real ******).

As far as my understanding goes is you have to get approval from the court. If you leave and move to anouther state then that is considered kidnapping, even though it is your child.
