Have to have more information:

Did you make a police report? Did the police question this person? Is this only for property damage within the limits of small claim court? Is this a situation you should let your insurance carrier pursue for subrogation rights? Does this involve an injury? Does this involve alcohol or drugs? Was the owner of the vehicle the one driving? If not, was it a permissive user?

On and on... need more info.

There are four (4) avenues you want to pursue: (1) police (to pursue criminal charges); (2) your insurance and/or the owner of the hit and run vehicle insurance company (to recover damages and losses per insurance policy); (3) court (in addition to the insurance claim, you want to sue the individual personally); and (4) DMV (you want to obtain the police report and/or judgement of the case to report a hit and run on the individual's driving record, which could result in additional penalties for the driver).

Yes. If your car is damaged and you were not injured write claim letter to owner (and operator) of vehicle. Letter should state date, time, location of accident; license plate number and state, if available; owner (and operator) was negligent and is responsible for damages to your car and repair costs; to forward copy of your letter to owner's automobile liability insurance company; company to contact you to settle; if, not, you will commence legal action.

If you were injured, get attorney. Also, if you have plate no., you or your attorney can get insurance company info. from Dept. Motor Vehicles and make direct contact w/insurance company.

Report it to the police and give it to your insurance agent. Your insurance agent should do all the work (but if they offer you a low settlement, don't sign, it is time to take it to a lawyer)

do the cops have this info if the do they will start the process for you if not you will need to file in court
