I work 40 hrs per/week for 5 days and,have one day off. Since i choose to work that day it becomes OT that amounts to 48hrs per/wk. I have sick days too. Now lets say i take one sick day off but show up for work on that day off should that day be counted as overtime?

Federal wage and hour law mandates overtime payment for hours actually worked over 40 per week. The 40 does not include hours you were paid for but didn't work, such as vacation, holiday, sick days or paid lunch time.

So no, the company is not required to pay you overtime for that day, even if they normally do for the extra day, since you didn't work over 40 hours that week.

Company policy, or union contract, might be more generous in the treatment of the time.

Pay for over 8 hours per day is no longer required by federal law, probably because of the many jobs where four 10-hour days have become standard. And the week doesn't have to be Sunday through Saturday, it's any consistent 168 hour (7 days times 24 hours a day) period.

Any time over 8 hours per day or 40 hours per week are overtime. If you work 10 hours on Monday and 6 hours on Tuesday--2 hours on Monday are OT. Then, if you work 8 hours on Wed, Thur. and Friday--you worked 42 for the week. 40 at regular pay and 2 hours OT. If you worked any hours on Sat. they would all be OT because you worked over 40 for the week.

Most likely no! Check your employer’s sick leave policies.

Most employers would consider that as overtime if you took a vacation day or if there was a holiday, but not if you take a sick day. That would be considered as regular 48 hrs - no overtime

no it would go back to your sick days acured are you geting payed for your sick days of?? and we are very suprised you are getiing anything over 40 hours nowdays most places only let you work, 37,8 or just under 40 that ways theres no benifits overtime anymore right your lucky!!
