We have just started the new year and we are at a new school. How long does the school have, by law, to put together an IEP? I thought it was 10 days from the time the student started at the school. Thank you

Does the child already have an IEP plan from the old school, or will this be a first IEP plan? Did the old school say the child qualifies for special ed services, or did the new school determine this?

A school is suppose to do evaluations on a child to see if child can qualify for special ed services (IEP)
School can not determine this without doing evaluations.
When the school does the evaluations to see if a child can qualify for special ed services, most states have 60 days from date of parent signed consent to have all tests completed. Then, IEP team is to meet to determine if child is eligible for special ed. If yes, the IEP plan is suppose to be made 'without delay'

There is no specific timeline for this in federal IDEA laws from the special ed eligibility determination until the making of the IEP plan. IT only states 'without delay'.
But, when the IEP plan IS made, it is suppose to be followed by the school 'immediately'.

If the child ALREADY has a IEP plan from the old school, the new school is suppose to start doing what is on it from day one. There is to be no delay.

Well, what state are you in and does your child have an IEP from the previous school?? The IEP is current for a full year --regardless of where it was written. So if it was written at the old school in May of 2006, it is still good until May of 2007 --regardless of the summer break or it being a new school and should be implemented immediately. A temporary placement can be made for up to 30 school days to give the school time to receive records such as IEP's from the previous school and the child would receive services during that time period. Hang tight and be polite --Do you want someone writing an IEP who has NO knowledge of your child?? They have to get an idea of functioning before they can write an accurate IEP --with your help of course! Again -- law can vary from state to state --so I tried to stick to federal guidelines when answering your question!!! Good luck to you!!

Once you sign the permission to evaluate form the district has something like 42 working days to evaluate your child. THen the district presents the results to you in a meeting. And finally, you will have a meeting to discuss the IEP. THey say you are part of the IEP team but they basically have the entire IEP completed. SUGGESTION FROM EXPERIENCE: do not sign the IEP that day. Take it home, review it, see if you want to make any changes in your child's program and then afterwards you will sign it with confidence. Keep a paper trail and mark all the dates you signed things and sent things to the district.Go to WRIGHTS LAW.....everything you need to know is there!

If a student has a current IEP (they are written for 1 year at a time) they have 10 school days to begin service. If you have just signed consent for an initial evaluation, there is a 60 day timeline. If the student is new to the district with an active IEP, the school has to comply with services immediately.

Give them thirty days to get an IEP in order, and if you feel you are getting the run around you may want to contact an advocate to give you advice on your next step. An advocate may even accompany you to a meeting with school officials to find out why an IEP has not been put in place, and what steps should be taken to have one put in to effect as quickly as possible. Some advocates even provide council, at no charge, when legal action has to be taken.

New schools ,probably new rules to.My girl is termed as devlopementaly delayed (13 years old/6grade)Go to the Schools Board of Education and ask for a copy of Special Education Student Rights and Regulations and take along a copy of your childs last end of year IEP report summary/Next Years plan of educaition insructional guideline. They need to get it done ASAP but until then the SPED staff works from the old plan. If testing is over a year old, the new school may need to update the testing even if it's not time for a reevaluation. In that case, a new plan would not be written until you signed permission for testing, the testing was done and the team convened. When the team meets, they should have some sort of draft plan to present to you. At the least, they need to have a service delivery grid. They then have three days to get a final plan to you and you have thirty days to get the plan back to them. All the while, the plan from your child's old school is intact and he/she will get services.
