Family Medical Leave Act applies to employers in the US who have at least 50 employees. If your employer is smaller than that, then you are not covered by FMLA, and yes, they can let you go while you're on medical leave.

If the employer has 50 employees, then they have to give you 12 weeks medical leave a year under FMLA if it's needed. You are only eligible for this if you've been with the employer for at least 12 months, and for 1250 hours in the 12 months preceding the leave.

Website dol.gov has information on the FMLA.

Your employment DOES has family med. leave. Family Medical leave is a FEDERAL LAW, and is mandatory to all employers. You don't specify what your situation is, so check on the internet what the exact laws are regarding your situation to see what your recourses are.

The FMLA is a federal law. I got fired over it and sued their *** off. You don't get paid while you're on it, they just have to keep your position open. You get 12 weeks a year by law.

HI, Did you hurt yourself at work?? if you did they can't take your job from you.And if you got hurt on the job,i think they have to pay you 2/3rd.(2 thirds) of your wages.you can get legal help free if your income is low.and they can answer all your question.

No they cannot. It is a FEDERAL law. They can't say they don't "have it." That's like saying they don't HAVE to pay income tax, of workers comp.
