This isn't as easy as it seems, especially if you said the dad has no custody. There would have to be a very good reason the dad wasn't awarded any type of custody. However, in the courts eyes, a child's opinion is taken seriously when they are about 12 yrs old, but this depends on that child's maturity level, school performance, relationship with the parent, etc. You can't walk into court and say "I want to live with my dad" and then it's done. You have to be assigned a guardian adlitem for the child, a social worker for the case and a mediator who will try to help you resolve any issues and reach compromise. It's a long process and it's expensive if your mother doesn't agree. It might be best to start off with some visitation with dad first, then see how it goes.

It depends upon your state laws. At 13, the state or the judge can choose to speak to the child in the chambers with an attorney present if the non-custodial parent wants to go to court for custody against the custodial. BUT, no matter what the age, you will STILL have to go to court to have the custody documents approved and changed. If you do not have these documents changed, the initial non-custodial parent will still be forced to pay child support. Go to an attorney and get a consultation on what the best option is. Most judges do not like to overturn their original decision, UNLESS it would be proven as a benefit to the minor child, and if custody does change to the father, then the father needs to request that he no longer be responsible of paying the mother child support, technically the mother should have to pay child support if the dad gains custody. If you don't change every last, little detail, then it can be a problem later on. Good luck!!!

make sure the kids has there head on there shoulders.if a child can divorce there parent's at the age of 8yrs old then a child can chose who thy want to be with a child has more rights then us.take the child to a sociology and make sure that child knows what thy are doing,it make you feel better.

wow- you should have used spell check! but since you didnt its okay. just ask your mom if you can live with your dad. ask if you can go for visits, and see if you like visting first, your mom, may know what is best!
