I live in CA and my ex in AZ. I haven't recieved child support from him at all due to that he is working under another name. Can I send him to court or is my case considered closed due to that he can prove he makes no income? I just don't wan to give up and let him sit on his a** and don't help me at all. Does anybody know what next step I can take here in CA?

You say he is working yet has no income. This does not make sense. Anyway, it doesn't really matter if he works or not because he must pay. If he doesn't then you can go after his assets or future earnings.

Get a lawyer. The case is not closed until the kids turn 18.

He still has an obligation to support his child. If you have a court order and he has not filed and had it modified, then support has been accruing and he owes it. Even if you don't have an order, you can get one. If you can get some proof that he is making money under ANY name, then your child is entitled to his/her share.

Another interesting concept that I saw used when deadbeats intentionally left jobs out of spite, thinking they could claim no income and duck their responsibility... Child support can legally be set based on the ABILITY to earn income. I saw many cases where a judge said the absent parent had to pay based on the ability to earn minimum wage. And in cases where there was proof that the absent parent had left a more lucrative job, support was set based on that higher salary since the fellow obviously had the ability to earn that much.

Go to your local child support enforcement agency. They can work in conjunction with the AZ agencies. They also should be able to access by computer what jobs he paid taxes on from years past and, if you know former employers, they can subpoena employment information once there is a served petition.

My experience in child support is from TN, but I suspect the approach in CA would be similar. Good luck!

If there is a court order, he owes, plus interest. Contact the child support enforcement people whatever they are called in CA or AZ and find out what to do. This is such BS. Yes, my ex works but has no income, too, I understand. He'll be spending his nights in jail, soon, though, and working days with the $$ coming to his kid instead of to his crank whore.

the child support is adding up no matter if he is working, in jail, not working etc. there is no way for him not to get out of paying.
my ex tried to claim bankruptcy to get out of it, you should have heard the judge lay into the stupid attorney and my ex.
you need to contact your attorney, or if you can't afford an attorney there should be some local government organaztion that can help you. better yet, contact your attorney and have you ex pay the attorney fees. if he had been paying like he was suppose to you wouldn't have had to hire the attorney, so make him pay.

it doesn't matter that he doesn't work. He must pay child support. It may be really low, but the courts will make him pay something. Your case is not closed go back and get a free attorney and they will give a supeana to come to court.

I always thought that the Support Bureau had ways of checking that stuff. Like with social security numbers. I'd call the Bureau and find out.

find out where he's working and what name he's using and give it to the states attorney my ex thought he could get out of paying it and gets social security he's so far behing they just started giving 65% of his ssi checks plus since he's on it my kids get it. it only took three yrs to get anything from him. just hang in there if your case is through public aid and you have a states attorney eventually they will get him first they will only suspend his licsense and put out a warrent but only where the support was ordered i don't know what they will do after that.

Go to the child support office and let them know what is going on and they can assist you in your next steps

No, you can reopen a case if it has been closed. My mother reopened mine when I was 35 years old. Get a private investigator to show he's working under another name or serve him as a.k.a at his job through his employer.
