does person A get charged with involuntary manslaughter, or has person B committed suicide?

There are way too many variables in this scenario for a solid answer. Was there any indication in B's history or from his family and friends that he was suicidal? Or was he jumping in front of the car for some other reason, such as avoiding another car? Why was B on highway in the first place? Was he just nuts or was he working construction on it? There are many reasons something like this could happen, and there are many things the police would take into consideration.

Also, it would depend on where it happened. The requirements for involuntary manslaughter are not the same everywhere. In fact, most require at least some sort of action or negligence on the part of the driver in a situation like that before they could be charged with anything.

So, just to be absolutely clear, it depends. It could be ruled B committed suicide and A was also charged. It could be ruled just B committing suicide and A gets off. It could be ruled that A is charged and B was just unlucky. It could be ruled a simple traffic accident with fatality, with no blame placed on either A or B.

Person B did commit suicide, BUT that can still be ruled as involuntary manslaughter IF person A could have tried to swerve out of the way.

If you could not avoid hitting B because he jumped if front of you at the last second it would be ruled an unavoidable accident.As for B committing suicide,that would be a separate investigation.

Person B is commiting suicide, driver A may get it too, depending on the many variables, both are in trouble.

This very thing happened to a friend of mine here in California. Lucky for him it was ruled an unavoidable accident and he was not charged. It did screw him up pretty bad though.
