In a free country, you'd be able to hire or not hire or fire whoever you wanted for whatever reason. And you could let your business be smoking or non-smoking as you chose.
The fact that this question is even asked is a sad, sad indictment on how far we've falled from the freedom and liberty and limited government of the Constitution.
It saddens me that so many people accept state authoritarianism when it suits their ends.
Me, I'd rather live in a country where I can be fired anytime, for any reason, than in one where the state meddled into private business affairs.

All states are "at-will employment" states.
"At-will employment is an employment relationship in which either party can terminate the relationship with no liability if there was no express contract for a definite term governing the employment relationship."
There is some statue of limitations:
"...federal anti-discrimination statutes which prohibit firing or refusing to hire an employee because of race, color, religion, sex, national origin, age, or handicap status are in place."
However, smoking is not part of a handicap, or any of the above. So in all states a business person can literally fire you because they don't like you.

I believe every state.
I know that you can't specifically declare in an add that you want a non-smoker but you can refuse to hire them because of it.
It's like if you're hiring a secretary, you can't put in the add "23 year old female secretary wanted, perferably blonde." or "Cook wanted must be black male." You would have to put something like "secretary wanted for auto dealership please contact...." or else you would have a law suit on your hands.

well it is like this, i can smell a smoker across the room(it's a disgusting smell they carry) and if i was hiring, i just wouldn't choose anyone that smelled like smoke.especially easy in a non smoking facility.
