Normally one person alone can't carry the payments on the marital home, it's a good idea to sell the house and split the proceeds. If there are kids involved, normally the custodial parent will get it.

A woman does not necessarily get the house in a divorce. Now usually she does if the couple have children and she gets custody. But alot of times the court will order both parties to sell the house and then split the equity in it.

In my case, I was willing to let my ex have the house because I wanted away from him so bad. It ended up that he didn't want to pay the payments on it, and it ended up being forclosed upon. If you get the house, please know that he might try to stalk you or cause you some type of trouble. It helps if you have children, you can get help paying for it, until you get your finances worked out.

Whomever can afford the house, gets it. If you both can afford it, then one should buy the other one off.

the judge has the final decision...but in most states ownership of asses ts are split, your lawyer and his will present the judge with what each other wants...he may or may not be angry at what you have...just depends on how bitter he is towards you now...
