Is severence pay void once you find a new job. For example, if my employer is telling me that I am entitled to two months severence (paid like how they would normally pay me if I was working) and if I find a job after one month do they still have to pay me for the other month. Help!

Depends on how they worded the offer. Do you have the terms on paper?

If they tell you the terms ahead of time and describe is to that they don't have to pay any longer, once you get a job, then, yes, they can withold any more payments.

There is no law that says they can't

If the tems have NOT been spelled out to you, you should ask for the terms, in writing. If this has not been written down, and they NEVER said they would stop the payments, then you might have a good case for a law suit.

If all you want to know is if you will get a paycheck, then you have to ask them. You won't get any real answers from us.

Yes-severance pay is usually given if you are laid off from a job for whatever reasons, not if YOU quit.

If your severance program is an ERISA program, it is a defined benefit that is unaffected by new employment.

Most companies that have a severance program that is a "lump sum" program that you get regardless.

As long as it is stipulated in your severance agreement, you get it.

there are no laws with regard to severence pay. It is a contractual agreement and depending on what terms and conditions are stated in your agreement, it may or may not cancel any severence pay your employer has offered you.

You've earned the severance whether you start working the next day or the next year.
