They can, but they can get in trouble for it too. Hooters was sued by a woman who they didn't hire because she had small breasts. She won, and they had to change their hiring rules.

They can hire based on ethnicity, but I don't belive that they are allowed to not hire someone based on that. The resturant would have to think of another reason not to hire the person, for example, they couldn't just say "well, we did not hire him/her because they are chinese". But they can hire whoever they want. If you are looking for a good job, I would advise an employer who is an "equal opportunity employer", because they are more likely to treat everyone fairly than an employer who hired mainly based on something like ethnicity or gender.

Not exactly. But there are subtler ways around it.

In her book, "Lads Before the Wind", Karen Pryor recalls that she needed to hire a Pacific Islander woman to perform in a Hawaiian-themed show with trained dolphins. So she had requirements to both race and gender and had to state them without appearance of discrimination. So after some deliberation, she came up with a header for a newspaper ad:

No, an employer is restricted by a multitude of equal employment laws from hiring based on age, sex, race, religion or national origin.

If you are qualified to work, you should be considered equally to others for the position.

It all depends on your states laws. Here in Alabama if a company only has a certain amount of employees they can basically do as they wish but after they exceed the amount of employees that the law requires then they have too follow the equal opportunity guide lines set up in the law. Can they do it? Yes. Should they do it? No, it is actually against the law to discriminate against any applicant based on ethnicity, religion or sex. It does happen though! Hope this helps

Not if they claim equal opportunity employer status. Some areas may also have laws against that.

no, but you have to prove that is why. especially in texas you CAN discriminate EXCEPT on the basis of race, sex, sexual orientation, religious preference, or disability* but if you are ugly or stupid, your screwed.


*on this one you have to have more than 80 employees i think.

Ie; a german restaurant (in usa) can hire a a german speaking waiter over a a english one...

It can be done if appropriate....usuaually isnt..
