The guy in front of me slammed on his brakes in the middle of an intersection, I dinged him. No air bags went off. The first thing he said when he got out of his car is that he'd been going to a chiropractor for 6 months from the last guy that him and just got his neck straightened out - and I went and screwed it all up again. I was not charged, fined, or ticketed. Damage to my vehicle was $200, his insurance claim was $5000 but for some reason he never followed through.

Can I still be sued for damages or can I breathe a sigh of relief?

This is in Ontario Canada.

This Kind of thing can have a tendency of hovering about only to return and savagely bite you in the ar$e!

I don't know if you can still be sued, but I don't think he actually had a neck problem. He just wanted to get some quick cash. If you're ever in another accident, take a picture of how many people are in the other car, or have them sign a piece of paper saying how many. Otherwise, by the time you get to court, they will have five people with whiplash.

He has up to 36 months to sue. However, if you weren't ticketed, he'd have a hard time proving anything in court. Should it come to that, I would advise you to subpoena his prior medical records to prove that you didn't cause the original condition.

Best of luck to you!

I believe I'd get on with my life and stop worrying about this incident. You were not even charged for the accident.

Don't worry about it...you would have heard something by now. Especially if it was reported to your insurance company. Have you heard anything since the accident?

There is a statute of limitation (usually one year), but I'd check to be certain.
