Is it legal to create a club/website and charge a membership fee if the club is based on anothers intelectual property? Assuming you give credit where credit is due... with out having written permission to use their work.

Just to make somthing up... If i create a Harry Potter fan club can i charge a 1$ subscription fee for acess to my web site?

Yes, user fees are perfectly legal. You have to pay them to access the National Parks in many cases and many State Parks also charge user fees. The whole idea behind user fees is to lessen the burden on taxpayers who don't use the service or facility. You typically pay them for drivers licenses, sewer service, trash collection, municipal golf courses, municipal swimming pools, municipal skating rinks and parks, etc. Totally legal and often very reasonable when compared to competing private facilities.

Do you know how much in copy rights you will have to pay to open, maintain the website? Just for the logo and name alone you probably dont have enough for.

Be creative and get your own idea. That way, you keep it all!!!

thats not a way to make money... People collect money by doing advertisement on their site and not charging the members..
