When my mother passed away, my son was of the mind to have me declared incompetent, put me on Medicade and throw me out in the street to 'find a place to live', rent out the house and make himself some extra income. Needless to say, I feel violated and incredibly angry. Then, the second son came over and took the trust with him. Has not brought it back to date. Should I be concerned, or just let it go?

The property has been transfered to me, also there was a pour-over will which named me exclusively.

Answer to Rich. I was thinking of taking out a reverse mortgage, use up all the money, and then leave the house to him. :)

Contact an Attorney ASAP . Make Sure you have a will . I don't know your children . But The Law is there for a reason . Sometimes it keeps honest people honest . An attorney can outline your rights and keep everything on the level . Besides he works for you .. Don't Wait .

I feel you should contact the probate office where you live for advice. I'm certain that you will have to find an attorney to represent you. If you cannot afford a lawyer, check for legal aid in your area. You are apparently competent to ask the question and know there's a problem. This seems to happen a lot! Its very sad, and I wish you the best.

You can create your own trust and leave it to this son that want to break your mother's trust. What goes around comes around. If this son does it to you, surely his son in turn will do the same.
It is better to correct him of his way now than to be sorry later. You are competent to write this message, you should have a sound mind.
