Depends on what state you live in. Some states have different ages of consent to have sex. Generally it's not statutory rape if the ages are so close together. But, for example, I live in Idaho, and sex between two unmarried people is illegal, but not enforced.
This list will tell you based on your state, what the age of consent is . If the age of consent is 18 in your state, then it's statutory rape until your sister is 18. If she didn't give her consent, then regardless it's rape.

Juliet" law, the provision limits the penalty for teen sex to 15 months in
jail, and does not require the perpetrator to register as a sex offender.
But the "Romeo and Juliet" law only applies to heterosexual teen-agers. Also
it is a felony for school employees to have consensual sexual contact with
students ages 16 or 17, even if it is only french-kissing.

Louisiana state Supreme Court declared the law constitutional in 1999

raping adult women, but the justices did not say whether it could be applied
to child rapists. The U.S. Supreme Court declined to hear the 1999 Louisiana

If someone was to get involved, like ur parents they really could say it was rape. Even with her consent, in most state. But if they were to do that, the judge would look at things such as, how close they are in age, if anyone knew that they were sexually active in the past. But if she told him NO, its rape no matter how u slice the pie.

if you mean statutory rape.......it depends on the law in your state......if it says under 18 and older ONLY is age of consent, then technically, it's statutory rape....sounds stupid but it is.....but yeah.
