Um. I have no legal examples. But I don't really think you should be scared if your batteries number isn't in the recall list. The recall list should be extensive enough to cover all possibly problematic battery - after all, if any batteries exploded again, they'll have serious consequences themselves too.

first off NO batteries EXPLODED they simply overheated and some caught fire. NOBODY was hurt at any time. Second off it has only happened to 60 batteries in 3 years and all of them were under extreme conditions. So RELAX. Finally if your battery is not on the list you will not get anywhere trying to ask for a refund (also lets not forget you are still going to want a computer and trust me if dell is recalling batteries today then all the others will follow in the next few weeks so then who are you going to buy from?)

If your laptop battery is not one of the ones that are listed, and you are still afraid to use the laptop, then you should follow the instructions that they give for you to take your laptop battery out and just use your laptop plugged in. You can do this without any fear of the battery overheating and exploding just fine. If you asked for your refund for the computer, I would guess that they wouldn't probably insist that you just take the battery out and use the computer instead plugged in to the wall.
