of course he can. he's the employer. i figure, you are the person on unemployment...trying to keep a little faith (i feel your predicament, trust me). OR, you are still employed, and hoping that someone who was laid off, doesn't have a chance in hell to come back to work :) lol. either way, good luck with that.

Sure - in some cases, such as a union layoff, this may be required before hiring other new employees.

However, don't sit and wait for that offer. Use the time to look at alternatives - you have nothing to lose, except maybe the chance to pick up the phone and tell your former employer that they need to give you an immediate raise, or you will take an offer from another company.
