I'm doing an assignment in my law class, and it's on whether or not downloading music from Napster is stealing. I'm supposed to be able to discuss it next time in class.

This is why it's illegal..

1. The copyright belongs to the songwriters
2. The music itself wasn't greated by you
3. It costs the entertainment industry ALOT of money to make the tracks in the first place
4. The tracks were put on CD's to be SOLD in stores.

I'm a recording artist/producer myself for my own recording label, and that's how I feel. IF the company does allow free downloads, then it wouldn't be considered stealing. IF the company is producing music for profit, than you are stealing. There's no reason of why not it isn't stealing.

Yes it is. There is only one reason I can think of which is because; your taking the property of another without right or permission. Thats actually one of the definitions of stealing.

However, I think that there are two kinds of stealing, one is the kind that people care to make a big deal about, and the other is the kind that people don't care or worry about, like stealing a pen from someones desk to fill out an important form.

Some people feel that downloading music for free is seriously wrong, while some others feel that stealing this music is no big deal. I personally don't think it's a big deal because many musicians try to rip people off by making one or two briliant songs, and then clearly putting little or no effort to the rest of the cd, but still wanting you to pay for it all. So you end up buying a cd that you only listen to hear one or two songs. You really only should have paid for those two songs, not 18 dollars for a whole cd you don't even listen to because it sucks. And you might have bought the cd because they only played the two good songs on the radio, making you believe this cd was a must buy, only to find out you got ripped off. So why not be able to download (steal) the song for free, and if the entire cd is great, THEN buy the cd because it's good to have an original copy and pay the artists for really doing a great job?

I download from Napster. No it is not stealing because I buy the songs I download. They musical artists have given Napster the rights to have their songs available for download. They do get their royalties from said downloads. Sorry can't come up with a fourth but i'm sure someone will for you.

Napster is now a pay site I believe so that is not stealing.

Downloading from other, non-sanctioned sites is because:
1. it is intellectual property - same as trade secrets & the ingredients in coke... can't have it unless the owner says so
2. everyone else has to pay for it... you found a way to get it without doing so and without that means being approved implicitly or explicitly by the vendor
3. it is stealing
4. it is stealing

I don't care for the big money stars who claim we're breaking their banks - they can all rot on the welfare line... BUT it is stealing.

No, it is copyright infringement.

Stealing implies that the victim no longer has what was stolen from him. That is not the case with copyright violation.

One could try to argue that money was stolen from the copyright holder, because they didnt get the purchase price for their music, but that assumes that the downloader would have purchased the music had they not downloaded it for free, which is not a valid assumption.
