Pretty much the same as in any other kind of mediation. The mediator has all of the parties in the same room, and each states his case. This can last from a few minutes to a few hours. Then the parties split into different rooms with their lawyers, and the mediator gets offers and demands and goes back and forth trying to persuade the parties to settle. He will bring up parts of the case to each side as part of this.
