From the Alabama criminal code:

Section 13A-6-62:

(a) A person commits the crime of rape in the second degree if:

(1) Being 16 years old or older, he or she engages in sexual intercourse with a member of the opposite sex less than 16 and more than 12 years old; provided, however, the actor is at least two years older than the member of the opposite sex.

(2) He or she engages in sexual intercourse with a member of the opposite sex who is incapable of consent by reason of being mentally defective.

So, it appears that 16 is the age of consent in Alabama.

EDIT: To anyone who thinks that it's a federal crime, you're also wrong. The Federal statute only applies to people who cross state lines for the purposes of having sex with a minor.

(c) With Children. - Whoever crosses a State line with intent to engage in a sexual act with a person who has not attained the age of 12 years, or in the special maritime and territorial jurisdiction of the United States or in a Federal prison, knowingly engages in a sexual act with another person who has not attained the age of 12 years, or knowingly engages in a sexual act under the circumstances described in subsections (a) and (b) with another person who has attained the age of 12 years but has not attained the age of 16 years (and is at least 4 years younger than the person so engaging), or attempts to do so, shall be fined under this title, imprisoned for any term of years or life, or both.

Probably stupid on the 16 yo part though, the only thing someone 27 wants with a 16 yo is to control them and take advantage of their naivete - At 16 you just THINK you are an adult and know everything, at 27, hopefully, you realize how little you do know. 16 is way too young for any 27 yo worth having

Not sure but here in North Carolina, 16 is the age of consent and they can't be charged with statutory rape.

pending on the situation.if it a rape then i believe it negative but if their is communication i believe it the choice of the two parties depending on the parents talk with the 16years old about sex.it might be a sweet 16 and not a rape.

I beleive it's considered illegal EVEYRWHERE in the world!

In NY if you are 17 it is not illegal.

But most other places it is 18 not 17.

It is 14 if BOTH are under 18.

If one is over 21 then BOTH have to be over 18 in the world.
