I'm a graphic designer, and my job is to copy these garments, down to the details. If the place ever got sued, will be held responsible as well?. They resell as they own label, and always as season later. It's not fashion, it's kids clothing.

Very gray area you are treading in! The one thing that stands out in your question is you say you copy the garments down to the details. Does this mean using their logos, character designs, things like that? If so then I would have to say yes you could be sued as well for copying this. Likely what would happen though if something did go wrong is the company would be sued, you could be sued but they would likely just go after the owners of the company. What you can do is go to the U.S. Copyright Office Website at http://www.copyright.gov/ There is a lot of information on there and I mean a lot!! You can read about the laws and all that stuff and if you are still confused I'd suggest getting advice from a lawyer.

Knock offs are not against the law as long as they don't claim to be the original. In other words it's OK to copy the general look but not the exact details. There are several companies the copy Oscar dresses and have them available in stores within a week of the broadcast. They use different materials, colors, and alter the details to make the design more affordable. In your case the original companies don't make the clothing for children. As long as your employer doesn't use the original designers name to sell the items your home free.

Oh ya, you are in it big time. If what you are doing infringes the other companies clothing line and copyright on those garments, you are certainly going to be brought up on charges as an accessory or even the main one blamed because you are the actual one doing the designs, if it came to that. Get a new job before you are designing prison garb.

The kids clothing that you are copying, was still designed by someone and is sold by someone. What you are doing is knowingly copying designs. I believe you would be in trouble if your boss's company got sued-and I believe, because they are unscrupulous, you would be thrown under the bus.
