Ok, my boyfriend want to claim his son everyother year but his ex wont give him the social security #. so how do i find out what the # is . would it be on school documents-i mean can he go to the school and find out. any ideas????

he is paying child support and gets to claim him everyother year but she won't give up the # and he doesn't have a copy of the birth certificate.

If he legally can claim him every other year I would call the IRS and ask for advice. They have a 1-800 number to answer questions. He could get in trouble if he did claim him and she claimed him so make sure that he has the legal right.

Claim? you mean as a dependant on taxes? Why every other year? How can he not know his own son's social security number. I think his son has to live under his roof for most of the tax year to claim him , not just be his son. Check with the IRS tax code before you get too caught up in the whole social security number thing. I'm assuming the child spends every other year with the father? I f she trusts the father that long why would she not give the code.

Try town hall with proof you are the father?

A social security number is not assigned until an application is made. If no application has been made, then no number yet exist for the child. SSN are not automatically given. If one does exist, the legal guardian(s) can probably go to the Social Security office and obtain a card. Other source may not and should not be available. For obvious reasons. In any case the father will need to deal with the Social Security office.

(Edit) Didn't see the part about not having a birth certificate. He will need to file a petition with your County Attorney's office.

You can replace your Social Security card for free if it is lost or stolen. However, you are limited to three replacement cards in a year and 10 during your lifetime. Legal name changes and other exceptions do not count toward these limits. For example, changes in noncitizen status that require card updates may not count toward these limits. Also, you may not be affected by these limits if you can prove you need the card to prevent a significant hardship.

To get a replacement card:

Complete an Application For A Social Security Card (Form SS-5); and
Show us documents proving:
U.S. citizenship (or immigration status and work eligibility); and
Identity.
Take (or mail) your completed application and documents to your local Social Security office.
All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies of documents.

Your boyfriend can not claim his son if the son lives with his mother. To claim a dependent the person must have lived in your boyfriends household for at least 6 months out of the year, and your boyfriend has to show that he provided for more than half of the child's support during that year. Normal child support and visitation arrangements don't meet that criteria.

If it's the son's, he can legally request it from her. If you're referring to HER number, it is illegal for you to use it without permission from her. If you get it and use to claim the son every other year, she can prosecute you to the fullest extent of the law. It's called identity theft. Assuming it's in their divorce agreement to do the every-other-year thing, you'll need to get a court to make her do it.

If that is legally his son he can find out just take the birth certificate to the courthouse

She probably already claimed her son on her taxes, so he couldn't anyway. Most likely you won't get the social security number because it is meant to be confidential, people don't put it on papers just lying around.

If he has joint custody, just contact the social security administration. There should be some seperation agreement stating who gets them as dependants, if not and she has physical custody. She's gonna win that fight.

It would be on the school documents but he would have to prove that he is the father before they can give out that information.
