sold an r.v., he defaulted, after 6mo of non payment had a court order to pay in full or return. it was returned. can i go to small claims for the 6mo owed?

I think since the property was returned you can't collect payments not made, because you can now sell it to someone else. I think if the value of the RV has depreciated significanlty you may be able to collect the difference, but it's unlikley

No you can't. You've already adjudicated this by stating pay or return. He returned, so the matter is moot. Now you have to mitigate your losses by reselling. The upside is that you also don't have to return his downpayment or any of his subsequent payments. You're done with him and just need to move forward now.

If it's under a certain amount. You'd have to check with the Clerk of Court to get the criteria.

definite. that's like someone renting your position for 6 months and by no skill paying, then shifting out. you'll sue em for the 6 months of non price. you may also promote it and sue them for the style. So in case you promote it for $5000 yet offered it for $7000 to them, you may sue for $2000 in depreciated loss.

small claims in Arizona-you can sue for anything. PAY IN FULL OR RETURN-meaning he obliged-he returned it. You-in all good conscience-should not sue. It would make you look like a turd.
