I was just informed today that my ex mother inlaw plans on taking my land away from me not sure how she can do that.My husband and i brought the land from my in laws shortly after that my husband passed away,in the deed the inlaws reserved life time rights. My mother in law told me that since they lived on the land that they would take care of the taxes i thought cool i have her grandkids to raise thought she was trying to be helpful, now i'm hearing that if she pays the taxes for 3 yrs in arow the land becomes hers. Does anyone know if this is true and if so how can i stop her from doing this. The land is in WV

If you bought the land and the deed reserved a life estate for your in-law then your mother has the right to live on the land until she dies. Your mother is known as a life tenant with a life estate.

I wouldn't worry too much, she can't possess your land if she's the life tenant. Plus adverse possession only applies to those who don't have their name on the deed. You can't adversely possess land you own. She's on the deed as the life tenant.

So when she dies, you get the land back. Don't worry she won't be able to sell the land. What you are hearing are half truths only.

I really don't know. YOu would probably want to contact someone within the county you live in and find out what you can. If she has the rights to the land then there is nothing you can do. But if you actually bought the land from her, and it is in your name, then she has no power. You need to look at the contract that you signed when you bought it and talk to someone in the city/county you live in. Good luck! I'm sorry for your loss and that you are going through this alone. I'll be praying for you.

If there a mortage on the land thru a bank . I'm sure they are paying the taxes on it . ...
