Hi our company anounced redundancy at the beg of august adn are now in consultation with reps with notification to the at risk staff happening on Monday. Are they allowed to hire new staff during this period?

Yes they can as long as they are not employing people to fill the jobs that have been made redundant

No they cannot until at leats 6 months have passed. The reason I know is because the company I work for has just had to make a member of staff redundant and the having had a look at the Redudancy Rules it states that we cannot hire for at least 6 months for the same position

Yes, provided it's for roles not being put at risk or being made redundant. i.e. If all sales stafff were being made redundant, they can still recruit non sales staff, however, the company should give priority to the sales staff with the right level of competence.

If they are hiring staff to do the same job and have the same title / job description as the people up for redundancy they are breaking the law.

Yes they are allowed to hire new staff. If the staff they are hiring are carrying out similar roles to those being laid off assuming that they are like-for-like payroll they are leaving themselves open to various legal issues. Some companies hire more HR staff to do the firing.

they are as long as they arn't hiring for the same jobs that they are making redundant.

I also think that they have an obligation to try and fill the positions with the 'at risk' people before they hire outside the company.

if a possition is redundant, they can't put someone else in that possition

They sure do. Don't think it is illegal, but it sure seems to be wrong.
