was arrested five yrs ago for endangering the welfare of a child by a court marshal. no charges were filed. after i bonded out of jail no court date was set nor was there a case number. now all of the sudden if a background check is done this shows up under a dfs(division of family services) report yet my criminal background check comes up clean and the report on the arrest says unsubstantiated....how can this be possible for it to show up not to mention it's been 5 yrs. ago. a srgt. from the sheriff's dpt. told me that this wasn't a formal charge just a notation. if nothing shows on my criminal background check then would an exspoungement even do me any good?

since my criminal background check comes up clean i called the highway patrol. if my criminal bachground comes up clean then i hv no arrest recors period. so an exspoungment won't do me ne good. thank you to all who have replied back to my answer. as far as dfs goes well i found a site click on this!http://www.thepetitionsite.com/takeaction/253404476
i hope you sign the petition so that these ppl can fight for wrongly accused parents and guardians due to fabricared or false info. by case workers. once this group gets 10,000 signatures they can begin thier investigation on all dfs offices in every state! yes i am a victim of dfs along with so many others. thanks again for all the replies to my question.

see an attorney who may be able to tell you the way in your state or county to get rid of it.

It will always show up. I had a friend who applied for a job at a bank and an item from her expunged sealed juvenile record came up. It did not list any specific charges or details but it listed the case as "disposition unknown" so she had to spend several weeks trying to prove what had happened.

Another person I knew was fingerprinted by police for purpose of exclusion and was never a suspect, let alone under arrest but it still shows up on background checks.

If no charges were filed, there would be no criminal record for you. Contact the County Attorney's Office in the county where it occurred and ask how to get this removed from your record.

Family Services will Never let go. They charge everyone falsely and even when ordered to stop sending this false report out will continue to do so. You are basically stuck forever.

It will show up. You can petition the courts to have it removed. Believe me, its there. Anything to make buck off of you.

If you were there, then they have a record of it. Its not about who is right or wrong, its about money. They need to not make records like this but they do, and its wrong!
