I have been with my defacto for 30 years, we broke up once for 12 months had a settlement, then we reconciled, for 3 years it did not work,now i want another settlement , he is saying we never lived together, the second time even though I gave him his first settlement back. Should I go for 50% of the estate, he also beat me up a lot.

You need a lawyer. My gut tells me you'll get nothing because you were ridiculous enough to give him the first settlement back. This is a rough situation and I hope you learn from it.

1. were you ever married.. broke up is not the same as divorced
2. was the settlement from the court
3. if you were never married then you have no LEGAL rights what so ever to his estate.. PERIOD
any sort of settlement between you and is just that.. if you gave it back to him and now want a 2nd settlement, he is not obliged nor are you entiteled to anything
most states do NOT recognize common law marriages
so even if he was de facto .. it not the same as a legal and binding contract that marriage ( as viewed by the states ) is,.

For your personal safety get out of the marriage! Hire a lawyer, and Keep your plans a secret and don't tell him what you are doing. Go for all you are entitled too. Don't worry about what he will say, the judges in court will decide who is the truthful one.

go for yours, i am a guy and i think that if you have been through the ringer then you should show people that karma still lives. especially if he beat you. he sounds like a coward, especially after you gave him a second chance, don't be scared, go for yours
